Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Smooth CDN (the “Service”), operated by Mirosław Gubała Beed Vision (“we”, “us”, “our”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

Smooth CDN is an asset delivery service that allows users to upload, manage, optimize, version, and deliver digital assets using CLI tools, dashboards, and APIs.

We may update, modify, or discontinue parts of the Service at any time, including adding, removing, or changing features.

2. Accounts and Registration

To use certain features of the Service, you must create an account. You agree to provide accurate and complete information and to keep your account credentials secure.

You are responsible for all activity that occurs under your account. You must be at least 18 years old to create an account.

3. Plans, Limits and Billing

Smooth CDN offers free and paid plans with defined limits. Limits may include the number of projects, assets per project, bandwidth, request counts, and usage history retention.

Current limits are described on the Pricing page and may change over time. Paid plans are billed in advance on a recurring basis unless canceled.

Usage quotas, including bandwidth and request limits, are calculated per billing period associated with the selected plan.

For the Free plan, the usage period begins on the date of the first CDN request and renews monthly. If no usage occurs, no new usage period is created until the next request is made.

For paid monthly subscriptions, usage quotas apply to each recurring billing cycle as defined by the payment provider.

For yearly subscriptions, the total annual quota is granted at the beginning of the yearly billing period and remains available until the end of that period.

Unused quotas do not roll over to subsequent billing periods unless explicitly stated otherwise.

4. Digital Service and No Right of Withdrawal

Smooth CDN is a digital service provided electronically and made available immediately after account creation or plan upgrade.

By purchasing a paid plan or any paid feature, you expressly agree that the Service is provided immediately and acknowledge that you lose your right of withdrawal under applicable consumer protection laws.

All payments are final and non-refundable, except where a refund is required by applicable law.

5. Acceptable Use

You agree not to use the Service to:

• distribute illegal content
• violate intellectual property rights
• distribute malware or malicious code
• abuse the Service or bypass usage limits
• interfere with the operation or security of the Service

We reserve the right to suspend or terminate accounts that violate these rules or pose a security or operational risk.

6. User Content

You retain ownership of the assets you upload to Smooth CDN. By uploading content, you grant us a limited license to store, process, optimize, and deliver your content solely for the purpose of providing the Service.

You are solely responsible for the content you upload and distribute, including ensuring that you have all necessary rights to do so.

7. Availability and Performance

We strive to provide a reliable and performant service, but we do not guarantee uninterrupted or error-free operation.

The Service is provided on an “as is” and “as available” basis.

8. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms, if your use poses a security or operational risk, or if required by law.

Upon termination, access to your content may be removed or restricted in accordance with these Terms and applicable law.

If your paid subscription ends or is canceled, your account may be downgraded to the Free plan. After downgrade, assets or usage exceeding the limits of the Free plan may remain temporarily accessible.

Unless the account is upgraded within 60 days from the downgrade date, Smooth CDN reserves the right to permanently delete assets and data exceeding Free plan limits without further notice.

It is your responsibility to download, migrate, or upgrade your plan before the expiration of this period if you wish to retain such data.

9. Intellectual Property

All intellectual property related to the Service (excluding user content) remains the property of Mirosław Gubała Beed Vision. You may not copy, modify, or redistribute the Service without permission.

10. Limitation of Liability

To the maximum extent permitted by law, Mirosław Gubała Beed Vision shall not be liable for loss of data, loss of profits or revenue, service interruptions, or any indirect, incidental, or consequential damages arising from your use of the Service.

11. Changes to These Terms

We may update these Terms from time to time. If changes are significant, we will notify users via the Service or email. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of Poland. Any disputes shall be resolved in the courts of Poland.
